Improving the forcibility of mechanisms and instruments for judiciary’s independence
The ISSH-S worked on the project “Improving the forcibility of mechanisms and instruments for judiciary’s independence in Macedonia”with “THINK AND LINK” – Regional Policy Programme’s support.
The project provided qualitative analysis of mechanisms and instruments, followed by the facilitation of symposia with the judges and promotion of the policy paper. The consultations within the Institute and with the wider legal expert community designed the best policy recommendations regarding instruments and tools for the purpose of reinforcing judiciary’s independence.
The research started with a screening of the current issues of forcibility within the system that was implemented using the data obtained by the survey conducted with the judges form different first and second level courts in Macedonia.
The main objective of the project was creating a novel policy on the use of instruments and mechanisms of the judiciary by way of conducting in depth research of the operational mode of the governing law and judicial organs and the hybrid unity they create, subjecting to critical assessment of the forcibility of instruments and mechanisms and proposing new modalities for new policies that effectively address the needs an independent judiciary.
The research leaded not only to the creation of new set of policies on the procedural tools that effectively produce judiciary’s independence by way of their operational forcibility but also to the development of a recommendations for appropriate use of those tools.
